TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of gregrubbert.com (the "Site"), operated by Greg Rubbert ("I," "me," or "my"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By visiting or purchasing from this Site, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, have read and understood these Terms, and agree to be bound by them. If you are accessing the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Products and Services

I offer digital products and professional services through this Site, including but not limited to film emulation presets and related creative tools. Product descriptions and availability are subject to change without notice. I make reasonable efforts to ensure product descriptions are accurate but do not warrant that descriptions are complete, current, or error-free.

3. Store Purchases — Paddle

Digital product purchases made through the Site's store are processed by Paddle, who serves as the Merchant of Record for all store transactions. By completing a store purchase, you agree to Paddle's Terms of Service and applicable policies, available at paddle.com/legal/buyer-terms. Paddle handles all payment collection, sales tax and VAT/GST calculation, and compliance with applicable consumer transaction laws for store purchases. Billing disputes relating to store purchases should be directed to Paddle in the first instance.

4. Invoice Payments — Squarespace Payments

Invoices issued by me are payable through Squarespace Payments, a native payment solution provided by Squarespace and powered by Stripe. By paying an invoice, you agree to provide accurate billing information. Invoice disputes should be directed to me at the contact information below. Squarespace Payments processes payment on my behalf; all invoiced services or products are provided directly by me.

5. No Returns or Refunds

All sales are final. Due to the immediately deliverable digital nature of the products sold on this Site, I do not offer returns, refunds, exchanges, or cancellations once a purchase has been completed and the product has been delivered or made available for download or access.

If you experience a technical issue that prevents you from accessing a product you have purchased, please contact me within 14 days of purchase and I will work in good faith to resolve the issue. This technical support commitment does not constitute a refund or return policy.

For invoiced services, payment terms and any applicable cancellation conditions will be stated in the invoice or accompanying agreement. In the absence of such terms, all invoiced amounts are due as stated and non-refundable once work has commenced.

6. Intellectual Property

All content on the Site — including text, images, portfolio work, presets, and digital products — is the property of Greg Rubbert and is protected by applicable copyright, trademark, and intellectual property laws. Unauthorized reproduction, distribution, modification, or creation of derivative works from any content or products without explicit written permission is strictly prohibited.

7. License for Digital Products

Upon purchase, you are granted a personal, non-exclusive, non-transferable license to use the purchased digital product for your own personal or commercial creative projects, unless otherwise specified at the time of purchase. This license does not permit you to resell, sublicense, redistribute, share, or otherwise transfer the product itself to any third party, whether for compensation or free of charge.

8. Email Communications

By signing up for the newsletter through this Site, you consent to receive periodic email updates and communications. You may unsubscribe at any time using the link provided in any email. I will not send marketing communications without your consent.

9. Prohibited Uses

You agree not to:

  • Use the Site in any manner that violates applicable local, state, national, or international laws or regulations

  • Attempt to gain unauthorized access to the Site, its systems, or any related infrastructure

  • Engage in any conduct that disrupts, interferes with, or degrades the Site or its functionality

  • Resell, redistribute, sublicense, or share purchased digital products without authorization

  • Remove, alter, or obscure any copyright or proprietary notices in purchased products

10. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. I do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any products will meet your specific requirements or produce any particular result.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GREG RUBBERT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT SHALL I BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Greg Rubbert from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

13. Third-Party Links and Services

The Site may contain links to or integrations with third-party websites or services, including Paddle and Squarespace. I am not responsible for the content, privacy practices, or terms of any third-party sites or services, and a link does not imply endorsement. Your interactions with third-party services are governed solely by their respective terms and policies.

14. Termination and Access Revocation

I reserve the right to suspend or terminate your access to the Site, or to revoke any product license granted, at any time and without prior notice if I determine, in my sole discretion, that you have violated these Terms or engaged in conduct harmful to me, other users, or third parties. Provisions of these Terms that by their nature should survive termination will do so, including Sections 6, 10, 11, 12, and 15.

15. Dispute Resolution

In the event of any dispute arising from or related to these Terms or the Site, you agree to contact me first at info@gregrubbert.com and give me a reasonable opportunity to resolve the matter informally before initiating any formal legal proceeding. This informal resolution period shall last at least 30 days from the date of written notice.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Missouri, and you consent to personal jurisdiction therein.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and Return Policy posted on the Site, constitute the entire agreement between you and me with respect to the subject matter herein and supersede all prior or contemporaneous understandings, agreements, or representations.

19. Changes to These Terms

I reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. For material changes, I will make reasonable efforts to provide notice.
